SALES CONTRACT

WHEREBY IT IS AGREED that for a consideration of

hereby acknowledges the Breeder agrees to sell and the

 Purchaser agrees to purchase the

kitten/cat described  herein as a:

• Purchaser agrees that Breeder requires a Holding fee (half down of the kitten/cat purchase price) which is non-refundable as this prevents us from selling the kitten/cat to someone else as we are holding/boarding/taking care of the kitten/cat for you and this will not be refunded if you change your mind.

• Purchaser agrees that he/she is not acting as an agent in the purchase of this kitten/cat and that the kitten/cat will reside at the home of the Purchaser.

• Purchaser understands that the color of the kitten/cat purchased is the best estimated color at the time of purchase. Kittens/cats may change color slightly or significantly with age and no exchanges or reimbursements are made due to color.

• Seller makes no guarantee as to the size, weight, personality, tail length, fur length, eye color, temperament, or any other God made features of the kitten/cat. These too can slightly or significantly change with age and no exchanges or reimbursements are made due to such.  

• Our kittens/cats are guaranteed to be of sound health, at the time of sale, and for a period of 72 hours. If the kitten/cat is found to be ill, during that time, it must be reported to the Breeder immediately. The Breeder should be contacted at once before any major treatment is begun. Do not proceed with any treatments unless you are making a decision to keep said kitten/cat. Purchaser understands that new kittens/cats may show signs of stress including, but not limited to sneezing, discharge from the nose and eyes, diarrhea and/or constipation. These effects can be minimized by feeding identical food as served by the breeder, offering bottled or distilled water and overall taking measures to reduce stress during integration period. If he/she is found to be medically deficient, with an untreatable or life-threatening genetic condition, within a year, it must be reported immediately to the breeder. A replacement kitten/cat of equal value will be provided within 1 year of the return/demise of the ill kitten/cat. This will be done ONLY with a certified veterinarian's certificate of diagnosis and/or cause of death. The kitten/cat cannot be returned after the 72 hours, and/or if he/she has been exposed to other animals that have not been currently tested for FeLV and FIV. It is the responsibility of the purchaser to provide immediate medical care if the kitten/cat shows signs of illness or distress. Failure to do so will render any guarantee null and void.

• Please note: 

  WARRANTY VOID IF FIP/FELV VACCINES GIVEN: We do not recommend vaccinating this cat/kitten with the FIP or FELV vaccines.  IF FIP AND FELV VACCINE IS GIVEN TO THE CAT/KITTEN AT ANY TIME, THE ENTIRE HEALTH GUARANTEE BECOMES NULL AND VOID.

• VACCINATIONS:  Your cat/kitten has had the required vaccinations relevant for their age, excluding FIP vaccine and FELV vaccine. If you choose to vaccinate for Feline Infectious Peritonitis (FIP), we recommend you discuss this with your own veterinarian and consider the risks. We do not consider the FELV vaccine safe for this breed. However, if there are special circumstances in your household, i.e. an indoor/outdoor cat that may expose this animal to the disease or a cat already in the household that is positive for Feline Leukemia, vaccinating for FELV (Feline Leukemia vaccine) may be done if your veterinarian recommends it. We pride ourselves in raising healthy, vaccinated, parasite-free kittens. Said cat/kitten leaves our cattery, to the best of our knowledge, in healthy condition. However, in the event that said cat/kitten should be diagnosed with a medical problem that can be cured, this would not qualify for a replacement. Our breeding stock is tested negative for FELV and FIV prior to entering our breeding program.

• Kittens/cats sold as Companion/Pets, will be spayed/neutered by a Veterinary Surgeon/Practitioner, "by and no later" than attaining the age of eight months. The purchaser agrees to prevent this kitten/cat from breeding without permission of Sullivan's Cattery. Not under any circumstances whatsoever to use the kitten/cat for breeding or allow the kitten/cat to breed with any other cat of the same or a different species, neither will the Purchaser allow any such use to be made of the kitten/cat by any other party. The purchaser will produce to the Breeder a Certificate/invoice from their Veterinary Surgeon/Practice stating that this has been carried out. The transfer/registration certificate will then be issued to the Purchaser. Purchaser understands that a $2500.00 fine will be owed to Breeder should it be found that kitten/cat sold on a Companion/Pet contract was bred. Any legal action which may arise under the terms of this contract will be brought in Anoka County, Minnesota. Buyer shall be liable for all court costs.
  

• Kittens/cats that are sold as breeders will come with full breeding rights and no restrictions on him/her or his/her offspring that is not included in an amendment to this contract, signed by both parties at the time of sale. The purchaser will be provided with all transfer/registration papers at the conclusion of the sale as dictated by this contract and any amendment that is included.

• If for any reason it becomes necessary for the Purchaser to transfer the kitten/cat to a third party the Purchaser undertakes to obtain from the third party a covenant in similar terms to those contained herein or the Purchaser agrees that this kitten/cat is not to be resold or given to any other person/cattery without being spayed or neutered. In the event of these covenants being breached the Breeder shall have the right to repossess legally the kitten/cat and to be reimbursed by the Purchaser the reasonable cost of such repossession and the keeping of such kitten/cat for a period of up to two months after repossession. Such costs to include Veterinary examination and fees, plus be fined $2500.00 for breach of contract. As previously said, any legal action which may arise under the terms of this contract will be brought in Anoka County, Minnesota. Buyer shall be liable for all court costs.
   

• Under no circumstances will the purchased kitten/cat be placed in a shelter, or abandoned.

• It is agreed that this kitten/cat will be maintained as an indoor-only pet, and not be allowed to roam freely outside. The purchaser agrees to provide a safe and healthy environment for this kitten/cat. Sullivan's Cattery feels very strongly about de clawing.

• De-clawing is an inhumane mutilation, and we will not allow our cats or kittens to be done. If this is a concern for you, please contact us for information on alternatives and options. Amputation of the first digit of the toes is painful and could alter the cats’ or kittens' personality, temperament and health.

Amendment to Contract - Breeding/Show kitten/cat:

• After receiving Breeders approval, the Purchaser shall breed this kitten/cat only to other Maine Coon, Desert Lynx, Highland Lynx, Alpine Lynx, Snow-Bob or CFA or REFR acceptable out cross. Under NO circumstance shall the Purchaser breed this kitten/cat to any breed other than the aforementioned.
   

This Agreement, consisting of three pages, is signed in duplicate, one copy for the Purchaser and the other for the Breeder, on the date of _____________________. If an electronic copy, both parties recognize the electronic copy as an original.
